Frankii Cruz claimed that it is not customary for him, "... to be evicted or renig on any of my past rental agreements, this information IS false."

The history of Frankii Cruz's rental responsibility for the property rented in Chula Vista is as follows:

On September 27, 2006 Frankii Cruz wrote a bad check to secure his apartment and moved in October 11, 2006. The check was returned October 23, 2006 and Frankii Cruz was fined $25 for a return check fee as well as $100 for an NSF fee.
Frankii Cruz paid rent late for the months of November 2006, February 2007, and April 2007 and was charged a $30 late fee each time.

By May 2, 2006 Frankii Cruz moved out of the apartment and the apartment complex (BRE Properties) had the carpets cleaned. It is unclear as to whether Frankii Cruz moved in with Donna but based on Frankii Cruz's statements, it is likely. However, on June 1, 2007 BRE Propteries filed an unlawful detainer with the San Diego Court so it is likely that after Frankii Cruz' relationship with Donna ended he returned to his old apartment.

On July 6, 2007 Frankii Cruz was served a notice to vacate the apartment and court documents state that Frankii Cruz' actual move out date was July 31, 2007. However, Frankii Cruz had begun dating Tiffany Jobbagy shortly after Donna ended her relationship with him and Frankii Cruz moved himself into Tiffany Jobbagy's apartment by August 2007.
